Mobile Applications and Texting Services
Mobile Application Users: With respect to each of Brookshire’s mobile applications (each an “App”), when you download the App or you create an account on the App, by selecting “I agree to the Terms and Conditions” and “I also understand the Privacy Policy” (or similar acknowledgements) you are expressly agreeing that you have read, understand, and agree to be bound by the Terms of Use and any amendments thereto, as well as Brookshire’s Privacy Policy. Brookshire makes the App available so that users may access Products and Services via a mobile device. To use the App you must have a mobile device that is compatible with the mobile service. Brookshire does not warrant that the App will be compatible with your mobile device. Brookshire hereby grants to you a limited, non-exclusive, non-transferable, revocable license to use an object code copy of the App for one registered account on one mobile device owned or leased solely by you, for your personal use. You may not: (i) modify, disassemble, decompile, reverse engineer or create derivative works of the App, except to the extent that such restriction is expressly prohibited by law; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer the App to any third party or use the App to provide time sharing or similar services for any third party; (iii) copy, reproduce, republish, upload, post, transmit or distribute the App in any way, unless specifically allowed in these Terms; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of the App, features that prevent or restrict use or copying of any content accessible through the App, or features that enforce limitations on use of the App; or (v) delete the copyright and other proprietary rights notices on the App. You acknowledge that Brookshire may from time to time issue upgraded versions of the App and may automatically electronically upgrade the version of the App that you are using on your mobile device. You consent to such automatic upgrading on your mobile device and agree that the terms and conditions of the Terms of Use will apply to all such upgrades. The foregoing license grant is not a sale of the App or any copy thereof, and Brookshire and its third-party licensors or suppliers as applicable retain all right, title, and interest in and to the App (and any copy of the App). Standard carrier data charges may apply to your use of the App.

Apple Users: With respect to any App that Brookshire provides to you designed for use on an Apple iOS-powered mobile device (an "iOS App"), the Terms of Use incorporate by reference the terms and conditions of the “Standard” Licensed Application End User License Agreement (“LAEULA”) published by Apple, Inc. (www.apple.com/legal/macapps/dev/stdeula). For purposes of the Terms of Use, Brookshire’s iOS App is considered the “Licensed Application” and Brookshire is considered the “Application Provider” under the LAEULA. To the extent that the Terms of Use conflict with any of the terms and conditions of the LAEULA, the Terms of Use shall control.

YourPoints

The yourpoints Fuel and Grocery Discount Program (“yourpoints Program”) is administered and operated by Brookshire Grocery Company (“Brookshire”).  The yourpoints Program is a benefit and reward available to eligible Brookshire customers enrolled in its Thank You Card program that have also registered for the yourpoints Program online at brookshires.com.  Subject to these Terms and Conditions, eligible customers may earn yourpoints when they purchase qualified non-fuel items at participating Brookshire retail locations and may redeem yourpoints to receive discounts on fuel and grocery purchases.

There are special terms and practices that apply when you enroll in Brookshire’s Thank You Card program and use Brookshire’s Thank You Card at participating Brookshire retail locations.  By using your Thank You Card and participating in the yourpoints program, you are agreeing to the terms and practices set forth in the Thank You Card Policy and to these Terms and Conditions as may be amended from time to time.  If you have any objections to either the Thank You Card Policy or these Terms and Conditions, you should immediately discontinue participation in the yourpoints Program.

How to earn yourpoints:

You must be at least 18 years of age to participate in the yourpoints Program.  If you are between 13 and 18 years of age, you may participate in the yourpoints Program only with the permission of your parent or legal guardian and your parent or legal guardian agrees to be responsible for your participation in the yourpoints Program, including use of any Thank You Card account.  You are entitled to earn yourpoints Program Points (“yourpoints”) only when you purchase qualified non-fuel items from participating Brookshire’s Food Stores or fuel kiosks, Brookshire’s Express Lanes stores, or Brookshire’s Zippy B stores, and you present your valid Thank You Card or required information regarding your Thank You Card account, i.e., telephone number provided at enrollment, at the time of purchase.

You will earn yourpoints equal to the amount spent on qualified non-fuel items only when you use your Thank You Card account, excluding any applicable sales tax or other tax required by law. For example, if you spend $1.67, excluding applicable taxes, on qualified non-fuel items using your Thank You Card, you will have earned 1.67 yourpoints. Qualified non-fuel items purchased also with a paper or printed store or manufacturer coupon (excludes coupons loaded electronically to your Thank You Card) will earn yourpoints for the amount paid for such item and the value of such coupon. Qualified non-fuel items purchased also with an electronic discount offer or coupon loaded directly to your Thank You Card will earn yourpoints only for the amount paid for such item. There is no limit on the number of yourpoints you can earn or accumulate.

Unless cancelled or terminated earlier, yourpoints expire at 11:59 PM CST, one calendar month from the last day of the month in which the yourpoints were earned.  For example, yourpoints earned on April 16 will expire at 11:59 PM CST on May 31.

You will NOT earn yourpoints on the purchase of the following items:

Fuel (all grades), tobacco, alcohol, pharmacy prescriptions (Arkansas only; in Texas and Louisiana, you may earn yourpoints only on out-of-pocket payments, not third-party payments, for pharmacy prescriptions), Brookshire’s Gift Cards, Western Union money order and money transfer services, postage stamps, lottery tickets, event or entertainment tickets, bill pay, check cashing, or other store office service items or fees, rental, deposit, or exchange fees, charitable donations, items purchased without using your valid Thank You Card, items purchased at any non-participating Brookshire retail location, and any other item prohibited by Brookshire in its sole discretion or by law.

yourpoints Fuel Rewards:

The yourpoints fuel discount allows you to receive a discount of 10¢ per gallon at participating Brookshire’s, Super 1 Foods, or FRESH by Brookshire’s fuel centers.  yourpoints can only be redeemed for a fuel discount at your election and once you have accumulated 100 yourpoints, and thereafter only in increments of 100 yourpoints.  You will be responsible for any applicable sales tax or other tax required by law on your fuel transaction.

To redeem yourpoints for a fuel reward, you must present your Thank You Card, or required information regarding your Thank You Card account, at the time of fuel purchase. All available yourpoints in your Thank You Card account will automatically be applied to the fuel transaction in increments of 100 by reducing the per gallon price of fuel by the amount of the yourpoints fuel discount you have earned prior to dispensing fuel.

In Texas and Arkansas, for each increment of 100 yourpoints redeemed, 10¢ off per gallon will be awarded. Subject to certain limitations, you may redeem multiple increments of 100 yourpoints in a single fuel transaction. Redemption of yourpoints for a fuel discount will be limited to a maximum discount of $1.00/gal. per fuel transaction. The value of yourpoints redeemed may not be greater than the per gallon price for fuel.

For example:
100 yourpoints = 10¢ per gallon fuel discount
500 yourpoints = 50¢ per gallon fuel discount
1000 yourpoints = $1.00 per gallon fuel discount

In Louisiana, for each increment of 100 yourpoints redeemed, 10¢ off per gallon will be awarded; there is a limit of 100 yourpoints that can be redeemed in a single fuel transaction.

For example:
100 yourpoints = 10¢ per gallon fuel discount

Fuel discounts at all locations are limited to one vehicle and a maximum of 30 gallons per fuel transaction; other limits may apply depending on the type of fuel pump accessed or whether certain restrictions have been placed on your payment card by your financial institution.

yourpoints Grocery Rewards:

The yourpoints grocery discount allows you to receive a discount of five percent (5%) on qualified non-fuel purchases at participating Brookshire’s Food Stores.  yourpoints can only be redeemed for a grocery discount once you have accumulated 500 yourpoints and you may redeem only 500 yourpoints in a single grocery transaction.  You may earn and redeem yourpoints in the same grocery transaction.  You will be responsible for any applicable sales tax or other tax required by law.

For example:
500 yourpoints = 5% grocery transaction discount 

To redeem yourpoints for a grocery reward, you must present your Thank You Card, or required information regarding your Thank You Card account, at the time of purchase of qualified non-fuel products.  At your election, if you have accumulated 500 yourpoints you may apply yourpoints to that grocery transaction, including yourpoints earned in the same grocery transaction, to reduce the cost of qualified non-fuel purchases by the amount of the yourpoints grocery discount.

You may NOT redeem yourpoints on the purchase of the following items:

Tobacco, alcohol, milk and dairy products (Louisiana only), pharmacy prescriptions, Brookshire’s Gift Cards, other merchant or third-party gift cards or prepaid services, Western Union money order and money transfer services, postage stamps, lottery tickets, event or entertainment tickets, bill pay, check cashing, or other store office service items or fees, rental, deposit, or exchange fees, items purchased without using your valid Thank You Card, items purchased at any non-participating Brookshire retail location, and any other item prohibited by Brookshire in its sole discretion or by law.

Checking the balance of yourpoints:

You are solely responsible for checking your yourpoints balance regularly to ensure that you are properly credited for all yourpoints earned.  yourpoints that you accrue will automatically post to your Thank You Card account at the time they are earned.  Your current yourpoints balance is available (1) online by accessing your Thank You Card account at brookshires.com, (2) through the Brookshire’s mobile application downloaded to your personal electronic device, or (3) on the bottom of your most recent register receipt from a participating Brookshire retail location.

Adjustments to yourpoints:

If you believe proper credit does not appear on your yourpoints balance or should you believe some other adjustment is necessary, you must notify Brookshire within sixty (60) days of the date the yourpoints were earned and provide any requested documentation to verify your purchase.  Brookshire reserves the right to determine in its sole and absolute discretion, and you agree such determination shall be final and binding, whether or not to adjust the yourpoints balance on your Thank You Card account accordingly.

Brookshire may refuse to record or honor any yourpoints in your Thank You Card account, or if already recorded, Brookshire may reverse, deduct, or cancel any yourpoints, if Brookshire cannot confirm that they were properly issued or obtained, or if they were earned on an item subsequently returned or exchanged for a non-qualifying item.  In the case of any failure by you to follow these Terms and Conditions or any other fraud or abuse related to the yourpoints Program, including but not limited to engaging in a pattern of returning or canceling products after the corresponding yourpoints have been credited, Brookshire reserves the right, in its sole discretion, to make any adjustments to the yourpoints balance in your Thank You Card account at any time and to take appropriate administrative or legal action against you.  In such a case, some or all of your yourpoints earned through the yourpoints Program may be forfeited and your Thank You Card account closed.  Brookshire reserves the right to seek reimbursement from you for the cost of any yourpoints you receive upon redemption of yourpoints that are subsequently reversed, cancelled, or deducted from your Thank You Card account.

Disclaimers:

You acknowledge that in order to administer the yourpoints Program, Brookshire will collect information about you and your purchases from participating Brookshire retail and fuel locations.  You authorize Brookshire to use and to disclose such information:  (i) to Brookshire representatives and agents in order to administer the yourpoints Program; (ii) to third parties, where necessary or convenient for transfer or redemption of your accumulated yourpoints or otherwise in connection with the yourpoints Program; (iii) to comply with requests, orders or subpoenas as required by law; and (iv) otherwise in accordance with the terms of Brookshire’s Thank You Card Policy.

You are responsible for maintaining the confidentiality of your Thank You Card account information and you agree that you are fully responsible for and agree to hold Brookshire harmless from all activities and use of such information other than by Brookshire that occurs under your Thank You Card Account.

Brookshire may, in its sole discretion, at any time and without prior notice: (i) discontinue all or any part of the yourpoints Program; (ii) change, discontinue or limit your access to the yourpoints Program or any functionality, feature or other component of the yourpoints Program, even if doing so may affect the number or value of yourpoints already accumulated; or (iii) suspend or terminate your use of or access to the yourpoints Program or your Thank You Card account, if Brookshire reasonably believes you breached these Terms and Conditions.

If no yourpoints are recorded in your Thank You Card account for any consecutive 24 month period, or if you commit fraud, misrepresent any information, violate any Terms and Conditions, abuse your yourpoints Program privileges or act in any other way to the detriment of Brookshire, its participating retail locations, merchants or the yourpoints Program, Brookshire may do any one or combination of the following: (i) suspend your ability to earn or redeem yourpoints; (ii) cancel any yourpoints in your Thank You Card account; (iii) terminate your enrollment in the yourpoints program; or (iv) terminate your Thank You Card account.

You may elect to close your Thank You Card account at any time by notifying Brookshire.  Upon closure, cancellation or termination of your Thank You Card account any rights to redeem yourpoints from your Thank You Card account are forfeited.  If any yourpoint expires or is cancelled or forfeited for any reason, it becomes void without compensation.

No yourpoints may be redeemed for any reward until it has been credited to your Thank You Card account.  yourpoints and any reward are non-transferable, have no cash, monetary or other value, cannot be converted into any currency, and may be canceled at any time.

The main purpose of Brookshire’s Thank You Card program is to thank and reward our customers for their patronage.  This Thank You Card Policy (“Policy”) describes many of the benefits offered to our customers when enrolled in the Thank You Card program.

In addition, your privacy is important to us and we are committed to safeguarding your personally identifiable information from unauthorized use or disclosure.  This Policy also describes how your personally identifiable information and other data may be collected and used by Brookshire Grocery Company, its affiliates, and agents (collectively, “Brookshire”), when you enroll in Brookshire’s Thank You Card program, either through this website or by submitting an application in person by visiting a Brookshire store, and when you use your Thank You Card at Brookshire stores.

Consent to Policy

You must be at least 18 years of age to enroll in the Thank You Card program.  If you would like a member of your household who is at least 13 years of age but under 18 years of age to participate in the Thank You Card program, you may request that we issue him or her a Thank You Card that accesses your account and you will be responsible for the use of the card and account by that person. By enrolling or participating in our Thank You Card program and providing personally identifiable information to Brookshire, you are agreeing to the terms and practices set forth in this Policy and to the collection and use of the information described in this Policy.  If you have any objections to this Policy, you should immediately discontinue use of your Thank You Card and request that any information submitted to Brookshire be deleted by completing and returning a change form.  Change forms are available at the store office of any Brookshire store and may be returned to any store office.  You may also delete any information submitted to Brookshire by notifying us using the contact information provided below.

How to Apply

You may obtain a Thank You Card by creating a new account on brookshires.com or downloading the app.  Membership in Brookshire’s Thank You Card program is free – there is no cost to you to enroll. 

How to Use

To use your Thank You Card, simply hand the cashier your Thank You Card or provide the cashier with your telphone number provided on your account creation.  You may also use your Thank You Card at any self checkout lane. Applicable discounts will be shown on the bottom of your receipt. 

Thank You Card Benefits

To be eligible to receive Thank You Card benefits you must enroll in Brookshire’s Thank You Card program and use your Thank You Card or Thank You Card key tag at participating Brookshire stores.  When you use your Thank You Card or Thank You Card key tag, in addition to receiving advertised specials, you may also receive special offers such as discounts and free offers on products you regularly purchase.  To receive Thank You Card benefits that are available to you only by email, you must create an online account by registering your email address online by visiting Brookshire’s website.  If you reach certain spending levels during specified periods, you may also be eligible to receive discount coupons for groceries, gifts, and chances to enter designated sweepstakes.  Use of a registered Thank You Card may also enable you to participate in Brookshire’s yourpoints Fuel and Grocery Discount Program and, subject to applicable terms and conditions, earn yourpoints on most purchases.  For detailed information on the Brookshire’s yourpoints Fuel and Grocery Discount Program.  Other Thank You Card benefits include a key return service and discounts or free offers from participating local businesses.  Additional details regarding Thank You Card benefits are available online by visiting Brookshire’s website.  THE THANK YOU CARD IS NOT A GIFT CARD OR GIFT

The Information We Collect

When you sign up for our Thank You Card Program, use your Thank You Card at Brookshire stores or any Site, or contact Brookshire, we may collect certain personal information from you such as your name, address, telephone number, email address, or other information about you or your interests (collectively referred to as “Thank You Card Information”).  This information does not include “aggregate information,” which is information Brookshire collects or receives about a group or category of persons or services, such as demographic or statistical information, or “de-identified information,” and from which Brookshire has removed any personal information.  We may provide aggregate information or other data about general groups of shoppers, shopping trends, or sales data to other companies to help them understand the demographics of our customers.

We may use the information we collect, including your Thank You Card Information, to provide products and services that are useful to you, to create merchandising and promotional programs, to analyze trends, administer the Site, track user’s navigation on the Site, and gather broad demographic information for aggregate use.  We also use this information, along with a record of your purchases, to offer savings awards and other promotions that are relevant to your purchase preferences.  We may also use this information to give you personally tailored coupons, offers or other information that may be provided to us from other companies.  These offers may be delivered to you in-store, at home, or online.  However, you have the right to “opt out” or choose if and how you prefer to receive them.  You may “opt out” by checking the designated box on the application form and you will not receive offers linked to the Thank You Card program.  To change your “opt out” preference, you may simply fill out and return a change form or change your preferences online at the Brookshire’s website.  Change forms are available at the store office of any Brookshire store and may be returned to any store office.  You may also change your “opt out” preference by notifying us using the contact information provided below.

Brookshire’s may share certain Thank You Card Information (name, address, telephone number, and email address) with our subsidiaries, affiliates, agents, representatives, marketing partners or other trusted third parties.

  1. For the purposes of operating our websites and postal or electronic mail, as well as respond to customer requests, concerns, or claims.
  2. We also share with trusted third party marketing partners and their agents for the limited purpose to display online, mobile, or other special marketing services.

Brookshire may disclose your Thank You Card Information when required by law or legal process (including pursuant to court orders, subpoenas, interrogatories, or similar directive carrying the force of the law).  We may disclose your Thank You Card Information if we believe that such disclosure is necessary or appropriate to comply with applicable law, to protect the rights, property or safety of Brookshire, other Site users, our partners, affiliates, sponsors, providers, licensors, or merchants, to prevent harm or loss, or in connection with an investigation of suspected or actual unlawful activity.

However, we will not rent or sell your Thank You Card Information to any nonaffiliated company or outside parties, except in connection with the sale of a pharmacy or other business unit, or as set forth in this Policy.

How to Change or Delete Your Information

If you have submitted any information to us, and you would like to update, change, or delete that information at any time, you may fill out and return a change form.  Change forms are available at the store office of any Brookshire store and may be returned to any store office.  You may update, change, or delete your personal information online at brookshires.com.  You may also update, change, or delete any information submitted to Brookshire by notifying us using the contact information provided below.  Your information will be updated, changed, or deleted accordingly in a commercially reasonable time.

Retention of Application and Change Forms

Application and Change forms for the Thank You Card program received by us at Brookshire stores are not retained after they are processed into our Thank You Card data system.  All Application and Change forms received are disposed of in accordance with current Brookshire policies regarding the disposal of confidential records.

To safeguard all information that we collect, we have instituted strict physical, electronic, and managerial policies and procedures to prevent unauthorized access, to maintain data accuracy and to ensure the appropriate use of all data.  However, no method of transmission over the Internet, or method of electronic storage, is completely secure.  Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

Children

Parents should always supervise their children while online.  The Thank You Card program and Brookshire’s website are not designed nor intended to collect personal information from children under the age of thirteen (13).  So that we may comply with the Children’s Online Privacy Protection Act, we ask that children under the age of thirteen (13) not provide any personal information on this website.  If you are a parent or legal guardian of a child under the age of thirteen (13) and believe he or she has disclosed personally identifiable information to Brookshire, please contact us immediately.  A parent or legal guardian of a child under the age of thirteen (13) may review and request deletion of a child’s personally identifiable information and prohibit its use.

Choice of Law:
The Terms of Use shall be governed by, and will be interpreted according to, the laws of the State of Texas, U.S.A., without regard to any conflict-of-law provisions.
